What are ‘inspired by’ fragrances?
A perfume which is sold as an ‘inspired by’ product smells pretty much exactly the same as the original, but it’s sold at a fraction of the price of the ‘real’ thing. Clearly, there’s only one version of the 100% genuine article and therefore, legally, it isn’t permissible to use the brand name and pass it off as, say, a Jo Malone, Yves Saint Laurent or Lancôme scent.
So, in summary – same quality and smell, different bottle, name and price tag.
We should stress that one thing inspired-by products are not is fake or counterfeit. It’s perfectly legal to create a fragrance which takes its inspiration from household-name brands. The only problem would be if these goods infringed on intellectual property laws such as copyrights or trademarks. For that reason, you can’t use precisely the same branding, logos or names on duplicate perfumes.
When buying big-brand names, you’re obviously paying for the name itself. Equally, the likes of Dior charge so much because they can, and because of their huge (and hugely expensive), glossy marketing and advertising campaigns. Original perfumes typically carry the weight of brand prestige and recognition. They symbolise heritage, craftmanship and luxury, all of which contribute to their premium position in the market and expensive price.
